BRIEF DESCRIPTION:

Amending the existing SFpark Pilot Program Areas and Division II of the San Francisco Transportation Code to change the territorial limits included in Parking Meter Zone Three, establish Parking Meter Zone Five and set applicable motorcycle parking meter rates.

SUMMARY: 

· In November 2008, the SFMTA Board of Directors approved resolution 08-192, which established SFpark pilot project areas and gave the Executive Director authorization to set parking fees within the pilot project areas until June 30, 2012. 

· In order to make certain the public is aware of the location of SFparkpilot program areas, descriptions of these areas will be added to the Transportation Code, Division II, Section 412 as a new metered area designated as Parking Meter Zone Five.

· Minor modifications to the SFpark pilot project areas are also being requested for clarification purposes, and are included within the Parking Meter Zone Five territorial limits.

· Rates for motorcycle parking within Parking Meter Zone Five are different than the rate used for non-pilot areas, Zones 1-4, which is calculated at one-fifth of parking meter rates for standard metered spaces. 

· The rates for motorcycle parking within Parking Meter Zone Five will be set between 25 cents and $1.20 to accommodate the demand-based pricing model being evaluated in the SFpark Pilot Program.

· Motorcycle Rates for Parking Meter Zone Five have been granted a categorical exemption from environmental review by City Planning.

PURPOSE

Amending the existing SFpark Pilot Program Areas and Division II of the San Francisco Transportation Code to change the territorial limits included in Parking Meter Zone Three, establish Parking Meter Zone Five and set applicable motorcycle parking meter rates within Parking Meter Zone Five.

GOAL

Amending the Transportation Code as stated above will further the following goals of the Strategic Plan in the following areas:

· Goal #2:  Customer Focus:  To get customers where they want to go, when they want to get there.

· Goal #3:  External Affairs-Community Relations:  To improve the customer experience, community value and enhance the image of the SFMTA, as well as ensure SFMTA is a leader in the industry.

· Goal #6:  Information Technology:  To improve service and efficiency, the SFMTA must leverage technology.

DESCRIPTION

Establishing SFpark Pilot Program Areas (Zone 5) in Transportation Code:

In November 2008, the SFMTA Board of Directors approved resolution 08-192, which established SFpark pilot project areas and gave the Executive Director authorization to set parking fees within areas for the duration of the SFpark Pilot.  The SFMTA Board approved extending the pilot projects to June 30, 2012 (09-167) by extending the existing agreement.  In February, 2010, the Board of Supervisors approved Ordinance 35-10, which allowed the SFpark pilot program to continue beyond the usual 2-year limit set by the San Francisco Administrative Code until June 30, 2012.

There are currently four zones for metered parking (Zones 1, 2, 3 and 4).  Within these zones, certain areas have been designated as SFpark pilot program areas.  To date, the SFpark pilot areas have not been entered into the Transportation Code.  The original boundaries for SFpark were drawn with respect to commercial districts, not existing meter rate areas, to help satisfy USDOT and SFMTA goals for the project. The original boundaries left two small areas where a few metered parking spaces have a different rate than all of the meters around them. One area consists of five city blocks adjacent to SFpark’s Fisherman’s Wharf Pilot Area bounded by Bay, Powell, Beach, and North Point Streets and has approximately 33 metered parking spaces. The second area consists of one city block adjacent to SFpark’s Downtown Pilot Area bounded by Montgomery, Washington, Kearny, and Jackson Streets and has approximately 45 metered parking spaces. SFMTA staff now proposes that these areas be added to the SFpark pilot program areas. These slight adjustments to pilot area boundaries will help make parking management more consistent in the Downtown and Fisherman’s Wharf areas.  In order for the public to be aware of the location of SFpark pilot program areas, descriptions of the SFpark pilot areas will be added to the Transportation Code, Division II as Section 412 (Parking Meter Zone Five).

In addition, a minor modification to Transportation Code, Division II, Section 404 is also needed to remove that portion of Parking Meter Zone Five previously covered by Parking Meter Zone Three.

Establishing Motorcycle Parking Meter Rates For Parking Meter Zone Five:

The Executive Director was granted the authority to set meter rates for the SFpark Pilot. However, rates for motorcycle metered parking within Parking Meter Zone Five are different than the rate used for non-pilot areas, Parking Meter Zones 1-4, which are calculated at one-fifth of parking meter rates for standard metered spaces.  Therefore, Transportation Code, Division II, Section 410 is being amended to set a motorcycle parking meter rate of between 25 cents and $1.20 to accommodate the demand-based pricing model being evaluated in the SFpark Pilot Program.

FUNDING IMPACT

In late 2009, the SFMTA changed the rates at motorcycle parking spaces from between $0.10 and $0.25 per hour to between $0.40 and $0.70 per hour, one-fifth the price of a vehicle space for each of the City’s meter rate zones. The FY2010 budget estimated that the 2009 rate increase would provide $600,000 in additional annual revenue. In FY2009, the SFMTA collected about $451,267 in total revenue from motorcycle meters. Based on revenue data since the rate increase was fully implemented, it is expected that motorcycle revenue will total about $546,735 in the first full 12 months after implementation, a $95,468 increase.   While it is expected that demand-based pricing at metered motorcycle spaces will further increase revenue at motorcycle spaces as prices vary to achieve an occupancy target, this information will be tracked to evaluate revenue expectations.

OTHER APPROVALS RECEIVED OR STILL REQUIRED

In 2008, the City’s Planning Department issued a categorical exemption from environmental review for the SFpark Pilot Program, which states that basic data collection, research, experimental management and resource evaluation activities do not result in a serious or major disturbance to an environmental resource. Although the SFMTA is amending the areas included within the SFpark Pilot Program, the Planning Department has determined that the existing categorical exemption from environmental review applies for the minor modifications to the pilot program areas.

The City Attorney has reviewed the item and Transportation Code Division II modification.

RECOMMENDATION

Staff recommends that the SFMTA Board of Directors authorize amending the existing SFpark Pilot Program Areas and Division II of the San Francisco Transportation Code to change the territorial limits included in Parking Meter Zone Three, establish Parking Meter Zone Five and set applicable motorcycle parking meter rates within Parking Meter Zone Five.

            RESOLVED, That the San Francisco Municipal Transportation Agency Board of Directors approves the amendments to Division II of the San Francisco Transportation Code to change the territorial limits included in Parking Meter Zone Three, establish Parking Meter Zone Five, and set applicable motorcycle parking meter rates within Parking Meter Zone Five as set forth in Appendix A.

Resolution amending San Francisco Transportation Code, Division II, by amending Section 404 to exclude that portion of the City and County of San Francisco included within Parking Meter Zone Five, amending Section 410 to set motorcycle Parking Meter Rates for Parking Meter Zone Five until June 30, 2012, and adding Section 412 to establish Parking Meter Zone Five to include SFpark Pilot Program Areas.

The Municipal Transportation Agency Board of Directors of the City and County of San Francisco enacts the following regulations:

Section 1.  Article 400 of Division II of the Transportation Code is herby amended by amending Section 404 to read as follows:

 SEC. 404.  PARKING METER ZONE NUMBER THREE.

  Parking Meter Zone Number Three includes that portion of the City and County of San Francisco not included within the boundaries of Parking Meter Zones Number One, Two [begin addition] , [end addition] [begin deletion] and [end deletion] Four [begin addition] and Five. [end addition] It excludes any part of the City and County of San Francisco under the jurisdiction of the Port of San Francisco.

Section 2.  Article 400 of Division II of the Transportation Code is hereby amended by amending Section 410 to read as follows:

SEC. 410.   PARKING METER RATES— MOTORCYCLES.

[begin addition] (a) [end addition] The hourly rate for motorcycle Parking Meters for [begin deletion] all [end deletion] Parking Meter [begin deletion] Areas [end deletion] [begin addition] Zone Numbers One through Four [end addition] shall be one-fifth the parking meter rate applicable to automobiles for that particular parking meter zone.

[begin addition] (b) The hourly rate for motorcycle Parking Meters for Parking Meter Zone Five shall be between $0.25 an hour and $1.20 an hour.  The provisions of this subsection shall expire on June 30, 2012. [end addition]

Section 3.  Article 400 of Division II of the Transportation Code is hereby amended by adding Section 412 to read as follows:

[begin addition] SEC. 412.   PARKING METER ZONE NUMBER FIVE.

(a) Notwithstanding the areas listed for Parking Meter Zones One through Four, Parking Meter Zone Five (the "SFpark Pilot Program Areas") shall include that portion of the City and County of San Francisco not under the jurisdiction of the Port of San Francisco and in the following areas:

(1) Downtown SFpark Pilot Program Area shall commence at a point where the northerly line of Folsom Street intersects the easterly line of The Embarcadero, thence south-westerly along the northerly line of Folsom Street to the westerly line of Fifth Street, thence north-westerly along the westerly line of Fifth Street to the northerly line of Market Street, thence easterly along the northerly line of Market Street to the westerly line of Powell Street, thence northerly along the westerly line of Powell Street to northerly line of Bush Street, thence easterly along the northerly line of Bush Street to the westerly line of Grant Avenue, thence northerly along the westerly line of Grant Avenue to the northerly line of Washington Street, thence easterly along the northerly line of Washington Street to the westerly line of Kearny Street, thence northerly along the westerly line of Kearny Street to the northerly line of Jackson Avenue, thence easterly along the northerly line of Jackson Avenue to the easterly line of The Embarcadero, thence south-easterly along the easterly line of The Embarcadero to the point of commencement.
