Amending San Francisco Transportation Code, Division II, by amending Sections 301, 302, 303, 304, 902, and 910 to increase the parking citation special collections fee, vehicle boot removal fee, fare evasion and passenger misconduct penalties, equipment violation fines, disabled parking fines, color curb painting fees, and parking permit fees for Special Traffic Permits, Residential Area Parking Permits, Contractor Permits, Vanpool Permits, Carpool Permits, SFMTA Parking Permits, Farmer's Market Parking Permits, and Temporary Street Closure Permits, amending Sections 305, 412, and 1009 to add towing and storage administrative fees, the special event parking meter rate for the South Embarcadero, Civic Center and Fillmore SFpark pilot program areas, and the monthly rate for parking on SFMTA property to the Transportation Code, and amending Section 910 to revise the SFMTA Parking Permit requirements and associated parking privileges.

 

SUMMARY:

Modifications to Division II of the Transportation Code require SFMTA Board approval.  The modifications proposed are as follows:

 

·       Modification 1 and 2: cost recovery and other fee and fine increases identified for FY 2012. 

·       Modification 3 – Disabled Parking Fine Increases. 

·       Modifications 4 –Penalty Increases for Equipment Violations.

·       Modification 5 –  Listing rate, fee, fine, and charge amounts in the Transportation Code. 

·       Modification 6 – Revising the SFMTA Parking Permit requirements and associated parking privileges.

PURPOSE

 

Amending San Francisco Transportation Code, Division II, by amending Sections 301, 302, 303, 304, 902, and 910 to increase the parking citation special collections fee, vehicle boot removal fee, fare evasion and passenger misconduct penalties, equipment violation fines, disabled parking fines, color curb painting fees, and parking permit fees for Special Traffic Permits, Residential Area Parking Permits, Contractor Permits, Vanpool Permits, Carpool Permits, SFMTA Parking Permits, Farmer's Market Parking Permits, and Temporary Street Closure Permits, amending Sections 305, 412, and 1009 to add towing and storage administrative fees, the special event parking meter rate for the South Embarcadero, Civic Center and Fillmore SFpark pilot program areas, and the monthly rate for parking on SFMTA property to the Transportation Code, and amending Section 910 to revise the SFMTA Parking Permit requirements and associated parking privileges.

 

GOAL

 

Approval of the resolution will support Goal 4 of the SFMTA’s Strategic Plan, Financial Capacity, which is to ensure financial stability and effective resource allocation.

 

DESCRIPTION

Modification 1 – Cost recovery increases to various fees and fines included in the FY2011-2012 budget.  These increases were considered during hearings on March 30, 2010 and April 20, 2010 as part of the two-year budget approval process.  Transportation Code modifications were approved by the SFMTA Board for FY2011 increases through formal amendment of the Transportation Code; however, Transportation Code modifications were not drafted for the FY2012 budget year since these modifications do not go into effect until July 1, 2011.  The FY2012 modifications, which consist of updates to Sections 304 (Color Curb Painting Fees) and 902 (Parking Permit Fees) are now being submitted as amendments to the Transportation Code, and are summarized as follows:

SFMTA Parking Permit Fee (Fee assessed for City and other vehicles to park at parking meters under the jurisdiction of the SFMTA without payment or for on-street reserved permit spaces assigned to City Departments ): 

o      Currently $924.  The fee calculation would change to be based on the daily Parking Meter Use Fee set forth in Section 312.  The fee would be calculated by multiplying the parking meter use fee by five days a week for fifty-two weeks per year.  For FY 2012, the annual permit fee will be $1,300.

 

Modification 2 – Additional cost recovery and other fee and fine increases identified for FY 2012.  In addition to the increases approved during the FY2011-2012 budget cycle, the following cost recovery and other fee and fine increases have been included for approval in support of the FY2012 budget.  It is estimated that increasing these fees and fines will result in the cost recovery of program expenditures in the FY2012 budget estimated at $300,000 for the Special Collections Fee and additional revenue of $100,000 for the increase in the Transit Fines:

 

·       Special Collections Fee (assessed for previously uncollected citations that require additional collections efforts): 

o      Currently $30.  The fee would increase to $40 on July 1, 2012.

·       Transit Fine for Fare Evasion and Passenger Misconduct

o      Currently $75 for the first offense.  The fine would increase to $100 on July 1, 2012.  This increase is required as a deterrence since the Fast Pass A is increasing to $72 as of July 1, 2011 which is $3 below the existing fine.

Modification 3 – Disabled Parking Fine Increases.  In January 2010, legislation AB 144 was signed into law to address the problem of disabled parking placard abuse.  AB 144 authorizes a civil penalty of not less than $250 and not more than $1,000 for parking in a blue zone without a valid license plate or placard, the misuse of a special license plate or placard, the use of a counterfeit, forged, altered or mutilated placard or special license plate and the use of a valid license plate or placard when it is displayed on a vehicle that is not being used to transport.  As part of the FY2011-2012 budget approval process, the SFMTA Board approved fine increases to three violations (CVC 22511.57 A-C) to set the penalty at $1,000.  However, SFMTA staff is now requesting that the fine amounts, currently $750, be increased to $850 instead and go into effect on July 1, 2011.  Recently, three additional disabled parking violations (CVC 22507.8A-C) were identified as qualifying for the same fine increase.  If approved by the SFMTA Board, these three fine amounts would increase from $303 to $850.  A ten percent additional penalty assessment ($85) will be imposed on all six violations pursuant to CVC section 40203.6.   The SFMTA has chosen to set the penalty at $850 instead of $1,000 because the DMV cannot accommodate processing citation totals in excess of three digits (i.e. $999), and to leave room for potential future penalty increases.  The approved FY2012 Budget includes $100,000 estimate for this fine increase.

 

Modifications 4:  Penalty Increases for Equipment Violations.  As part of the recent State Audit, equipment-related violations were identified as being subject to the California Uniform Bail and Penalty Schedule (CUBPS).  CUBPS is a list of fine amounts the State has set for violations in several categories in order to have uniformity in penalty amounts.  For equipment violations, local jurisdictions who assess these fines must pay the State fifty percent of the amounts collected. Therefore, fines for the violations below should be increased to the amount set forth in CUBPS which is $114.  Since the State collects $57 for each citation listed, if citation amounts remained at their current levels, this would have a continued negative impact to the FY2012 budget of approximately $500,000.

Modification 5:  Listing in the Transportation Code of rate, fee, fine, and charge amounts previously approved.  Although these amounts are usually listed on the SFMTA's, SFpark's or other websites, it is important to list them in the Transportation Code, which is the official codification of traffic and transit fees, fines, rates and charges for the City.  The following will be added:

·       Special Collections Fee (Division II, Section 301, subsection c):  Entering this fee into the Transportation Code assumes passage by the SFMTA Board of the increase from the current fee of $30, as noted in Modification 2 above.

·       Boot Removal Fee (Division II, Section 301, subsection d):  This fee was approved as part of the FY2011-FY2012 budget approval process, as noted in Modification 1 above.

·       Administrative Fee for Vehicle Towing (Division II, Section 305):  The fee ($186.50) was approved as part of the FY2011-2012 budget cycle, and does not include tow-car operator assessed fees for performing towing services.

·       Administrative Fee for Vehicle Storage (Division II, Section 305):  The fee ($2.25 per day, prorated the first day to $2 since the first four hours of storage are free) has not been modified since its original passage as part of the FY2008 budget cycle. 

·       Special Event Parking Meter Rate (Division II, Section 412):  Between $0.25/hour and $18.00/hour during, or up to four hours prior to special events in the South Embarcadero, Civic Center and Fillmore SFpark Pilot Program Areas.  This parking meter rate range was approved in 2008 as part of the SFpark Pilot Program approval (Resolution 08-192).

·       Monthly Rate to Park on SFMTA Property (Section 1009): The monthly rate shall not exceed the cost of a Municipal Railway/BART pass (Fast Pass A) plus ten dollars.

 

Modification 6:  Revising the SFMTA Parking Permit requirements and associated parking privileges.  The SFMTA is revising the SFMTA Parking Permit requirements to formally exclude maintenance, emergency response, and any other vehicle whose primary purpose is not the sole transport of passengers and are being used for official City business.  The permit requirements will apply only to passenger vehicles including sedans, sports utility vehicles (SUVs), and minivans.

 

ALTERNATIVES CONSIDERED

 

Modification 1:  Since the fines, fees and rates for these modifications were evaluated and approved as part of the FY2011-2012 budget review, and this action merely adds them to the Transportation Code, no alternatives were considered.

 

Modification 2:  Not raising the Special Collections Fee and the Transit Fine.

 

Modification 3:  Since fine increases for CVC section 22511.57 A-C violations were evaluated and approved as part of the FY2011-2012 budget review, and this action now adds the fine to the Transportation Code but at a new penalty amount, no alternatives were considered.

 

Modification 4:  Alternative:  Not raising the equipment fines.  Should the fines in this category not be raised, the SFMTA would still owe the State $57 for every citation issued.

 

Modifications 5 and 6:  Both of these modifications are done to list specific fees and rates already approved by the SFMTA Board.  Since the items are informational, no alternatives were considered.

 

 

 

FUNDING IMPACT

 

Modifications 1 and 3 do not affect the FY2012 budget, since revenue items were already approved and reported as part of the FY2011-2012 budget process. 

 

Approval of Modifications 2 and 4 enables the SFMTA to recover costs involved in providing the associated services to the public and to pay the State their portion of fines collected for equipment violations.

 

There are no funding impacts for Modifications 5 and 6.

 

PUBLISHED NOTICE AND PUBLIC HEARING

 

Pursuant to Charter Section 16.112 and the Rules of Order of the Board of Directors, advertisements were placed in the City’s official newspaper to provide notice that the Board of Directors will hold a public hearing on May 3, 2011 to consider the above modifications.  In compliance with these requirements, the advertisement ran in the San Francisco Examiner for a five-day period beginning on April 13, 2011.

 

APPROVALS RECEIVED OR STILL REQUIRED

 

Increases to fees, rates, fines and charges are subject to environmental review under the California Environmental Quality Act (CEQA).  The Department of City Planning has determined that changes in various fines, fees, rates and charges, as itemized in Attachment A to this Resolution, including increases to the parking citation special collections fee, vehicle boot removal fee, fare evasion and passenger misconduct penalties, equipment violation fines, disabled parking fines, color curb painting fees, and parking permit fees for Special Traffic Permits, Residential Area Parking Permits, Contractor Permits, Vanpool Permits, Carpool Permits, SFMTA Parking Permits, Farmer's Market Parking Permits, and Temporary Street Closure Permits are statutorily exempt from environmental review under California Public Resources Code section 21080(b)(8) and CEQA implementing guidelines, Title 14 of the California Code of Regulations section 15273 because the increases will be used to meet operating expenses including employee wage rates and fringe benefits, or to purchase or lease supplies, equipment, or materials.

 

RECOMMENDATION

 

It is recommended that the SFMTA Board of Directors approve the following modifications to Division II of the Transportation Code:  Amending Sections 301, 302, 303, 304, 902, and 910 to increase the parking citation special collections fee, vehicle boot removal fee, fare evasion and passenger misconduct penalties, equipment violation fines, disabled parking fines, color curb painting fees, and parking permit fees for Special Traffic Permits, Residential Area Parking Permits, Contractor Permits, Vanpool Permits, Carpool Permits, SFMTA Parking Permits, Farmer's Market Parking Permits, and Temporary Street Closure Permits, amending Sections 305, 412, and 1009 to add towing and storage administrative fees, the special event parking meter rate for the South Embarcadero, Civic Center and Fillmore SFpark pilot program areas, and the monthly rate for parking on SFMTA property to the Transportation Code, and amending Section 910 to revise the SFMTA Parking Permit requirements and associated parking privileges.

            WHEREAS, Multiple modifications to the Transportation Code, Division II are required to properly assess and enforce certain policies approved by the SFMTA Board of Directors as described below; and,

 

            WHEREAS, The first modification would add to the Transportation Code cost recovery fee and fine increases proposed for implementation on July 1, 2011 in support of the FY2012 budget; and,

 

            WHEREAS, The second modification is for additional cost recovery and other fee and fine increases identified for FY 2012, including the special collections fee, the SFMTA Parking Permit fee, and transit fare evasion and passenger conduct penalties; and,

 

            WHEREAS, The third modification increases disabled parking fines, three of which were approved by the SFMTA Board and are subject to implementation on July 1, 2011, and three additional disabled parking violations that have been identified and require Board approval to increase the fine amount; and,

 

            WHEREAS,  The fourth modification increases the fine amount for equipment-related violations to the amount listed in the California Uniform Bail and Penalty Schedule, which the State is entitled to fifty percent of for all amounts collected; and,

 

            WHEREAS, The fifth modification adds the dollar amounts for some rates, fees, fines, and charges to the Transportation Code for easy public reference;

 

            WHEREAS, The sixth modification amends Section 910 to revise the SFMTA Parking Permit issuance and application process and associated parking privileges; and

 

WHEREAS, Pursuant to Section 10 of the SFMTA Rules of Order and Charter Section 16.112, a duly noticed public hearing concerning the fine, fee, rate and charge increases was conducted on May 3, 2011; and

The Municipal Transportation Agency Board of Directors of the City and County of San Francisco enacts the following regulations:

Section 1.  Articles 300, 400, 900 and 1000 of Division II of the Transportation Code are hereby amended by amending Sections 301, 302, 303, 304, 305, 412, 902, 910, and 1009, to read as follows:

SEC. 301. - LATE PAYMENT; SPECIAL COLLECTIONS AND BOOT REMOVAL FEE.

(b)      [begin addition] Exemptions from White Zone Fees. [end addition] The following entities shall be exempt from paying white zone fees so long as such entities are primarily conducting nonprofit activities at the location of the white zone:

(1)      Government buildings open to the public;

(2)      Buildings occupied by private nonprofit organizations whose exclusive function is serving senior citizens and persons with disabilities; and

(3)      Private nonprofit educational institutions whose exclusive function is providing education to students in any grade from kindergarten through eighth grade.

(c)      Nothing in this Section is intended to limit the SFMTA's ability to install color curb markings on its own initiative.

SEC. 305. – TOWING AND STORAGE ADMINISTRATIVE FEES.

[begin addition] The SFMTA shall charge the owner of a towed vehicle a [end addition] [begin deletion] A [end deletion] fee [begin addition] in the amount of $186.50 [end addition] to reimburse the City for [begin addition] administrative [end addition] costs [begin addition] related to the removal, impound, or release of [end addition] [begin deletion] incurred in the administration of the procedures for towing [end deletion] vehicles [begin addition] towed [end addition] from [begin deletion] within [end deletion] the public right-of-way [begin deletion] shall be charged to the owner of a vehicle towed from the public right of way by the SFMTA or the Police Department [end deletion] .   [begin addition] In addition, the SFMTA shall charge the vehicle owner a fee to reimburse the City for administrative costs related to the storage of such towed vehicles in the amount of $2.00 for the first day of storage (24 hours or less), and $2.25 for each day, or part thereof, that the vehicle remains in storage after the first 24 hours.  [end addition] [begin deletion] The Director of Transportation is authorized to establish the fee in an amount reasonably calculated to cover the actual costs incurred by the City in towing vehicles from the public right of way. SEC. 412. - PARKING METER ZONE NUMBER FIVE.

(a)      Notwithstanding the areas listed for Parking Meter Zones One through Four, Parking Meter Zone Five (the "SFpark Pilot Program Areas") shall include that portion of the City and County of San Francisco not under the jurisdiction of the Port of San Francisco and in the following areas:

(1)      Downtown SFpark Pilot Program Area shall commence at a point where the northerly line of Folsom Street intersects the easterly line of The Embarcadero, thence south-westerly along the northerly line of Folsom Street to the westerly line of Fifth Street, thence north-westerly along the westerly line of Fifth Street to the northerly line of Market Street, thence easterly along the northerly line of Market Street to the westerly line of Powell Street, thence northerly along the westerly line of Powell Street to northerly line of Bush Street, thence easterly along the northerly line of Bush Street to the westerly line of Grant Avenue, thence northerly along the westerly line of Grant Avenue to the northerly line of Washington Street, thence easterly along the northerly line of Washington Street to the westerly line of Kearny Street, thence northerly along the westerly line of Kearny Street to the northerly line of Jackson Avenue, thence easterly along the northerly line of Jackson Avenue to the easterly line of The Embarcadero, thence south-easterly along the easterly line of The Embarcadero to the point of commencement.

[begin addition] (c)       Notwithstanding subsection (b), the Director of Transportation is authorized to set a Special Event Parking Meter rate between $0.25 an hour and $18.00 an hour during, or up to four hours prior to, special events in the South Embarcadero, Civic Center and Fillmore SFpark Pilot Program Areas to recover the costs incurred by the SFMTA for parking-related services in connection with the special event.  For purposes of this subsection, a special event shall include athletic events, concerts, conventions, major parades, street festivals, entertainment or cultural exhibitions or shows, or any other similar event that is expected to generate a significant, short-term demand for on-street parking.  [end addition]

SEC. 902. - GENERAL PERMIT CONDITIONS.

The following general provisions apply to all permits issued under this Article.

(a)      [begin addition] Application and Renewal. [end addition] Permit applications must be submitted on a form supplied by the SFMTA. All required application fees must be paid and all permit requirements satisfied before a permit may be issued. The SFMTA may require any information of the applicant which it deems necessary to carry out the purposes of this Article. Permits may be renewed annually in compliance with any renewal procedures established by the SFMTA.

[end addition] Permittees must maintain the permit at the site of the permitted activity and available for inspection in accordance with any requirements for permit display as may be established by the SFMTA, and shall make all permits available for inspection upon request by an employee of the Police Department or SFMTA.

(c)      [begin addition] Prior Payments Required. [end addition] No permit shall be issued or renewed until the applicant has paid all permit fees that are due to the SFMTA. No permit shall be issued to any applicant who is responsible for payment of one or more delinquent citations for violation of any provision of this Code or the Vehicle Code until all fines and fees associated with the citation are paid in full.

(e)      [begin addition] Indemnification. [end addition] The permit application for Special Traffic Permits issued pursuant to Section 903, and permits for the Temporary and Exclusive Use of Parking Meters issued pursuant to Section 904, shall require the applicant to acknowledge that the Permittee, by acceptance of the permit, agrees to indemnify and hold the City and County of San Francisco, its departments, commissions, boards, officers, employees and agents ("Indemnitees") harmless from and against any and all claims, demands, actions or causes of action which may be made against the Indemnitees for the recovery of damages for the injury to or death of any person or persons or for the damage to any property resulting directly or indirectly from the activity authorized by the permit regardless of the negligence of the Indemnitees.

(f)       [begin addition] Rules and Regulations. [end addition] Compliance with all applicable rules and regulations and with all permit conditions shall be a material condition for the issuance or renewal of a permit.

(g)      [begin addition] Permit Revocation. [end addition] The Director of Transportation is authorized to revoke the permit of any Permittee found to be in violation of this Article and, upon written notice of revocation, the Permittee shall surrender such permit in accordance with the instructions in the notice of revocation.

SEC. 910. - SFMTA PARKING PERMIT.

(a)      [begin addition] General Permit Requirements. [end addition]

          (1)      The SFMTA shall issue a SFMTA permit [begin deletion] for use by a specific vehicle [end deletion]           upon receipt of a written application from a qualifying City employee or department. [begin deletion] No more than one permit shall be issued to each vehicle for which an application is made. [end deletion]

[begin deletion]             (2)       [end deletion] The permit [begin deletion] s [end deletion] shall b [begin addition] e [end addition] [begin deletion] y [end deletion] displayed by City employees only when the vehicle is used for official government business. 

          [begin addition] (2)       The SFMTA permit requirements shall only apply to passenger vehicles including sedans, sports utility vehicles (SUVs), and minivans.  City maintenance, emergency response, and any other City vehicle whose primary purpose is not the sole transport of passengers shall not be required to obtain a SFMTA permit and shall be granted the same permit privileges to Park as provided in subsection (b).  [end addition]   

(b)      [begin addition] Permit Privileges. [end addition]

          (1)      Any vehicle that displays a valid SFMTA Parking Permit shall be           permitted to Park at a Parking Meter without depositing payment as required by       Division I, Section 7.2.23 (Payment of Parking Meter) [begin deletion] ; except that in a metered yellow zone a vehicle displaying a SFMTA Parking Permit is still subject to enforcement     of posted time limits [end deletion] .

          (2)      The SFMTA Parking Permit does not exempt vehicles from any other   Parking restrictions other than as set forth in Section 801 [begin addition] . [end addition]

          (3)      The SFMTA Parking Permit does no [begin addition] t [end addition] excuse applicable time limits in         Residential Parking Permit areas, at parking meters, or any other time restricted      parking areas unless specifically authorized by the SFMTA.

(c)      [begin addition] Duration of SFMTA Parking Permit. [end addition]

          New SFMTA Parking Permits may be issued by the SFMTA at any time during the fiscal year but every permit shall expire on June 30 of each calendar year unless renewed.

(d)      [begin deletion] Application. A written application may be submitted at any time during the calendar year, and shall include the names of each employee who would use the SFMTA Parking Permit that is requested, the vehicle license plate number, the demonstrated need for the permit, and such other information as the SFMTA may require. [end deletion] [begin addition] Permit Fee.  The SFMTA Parking Permit fee shall be based on the daily Parking Meter Use Fee set forth in Section 312.  The permit fee shall be calculated based on a five day per week period for fifty-two weeks per year.  [end addition]

SEC. 1009. - PARKING RESTRICTIONS ON SFMTA PROPERTY.

(a)      It shall be a violation for any person to Park any non-SFMTA owned vehicle, whether attended or unattended, in any of the locations listed below without displaying valid proof of payment for Parking at such location. Any vehicle Parked in violation of Section 1009 may be subject to issuance of a citation or removal by the SFMTA.

(b)      (1) Within the property lines of the SFMTA building commonly known as the           Cable Car Barn or 1201 Mason Street (Lot 005, Block 0190) and bounded by             Jackson Street, Mason Street, Washington Street, and the property line 200 feet                   west of Mason Street.

          (2)  Within the property lines of the SFMTA building commonly known as Woods     Operations and Maintenance Yard or 1095 Indiana Street (Lot 002, Block 4169;             Lot 010, Block 4170; Lot 021, Block 4171) and bounded by Iowa Street, 22nd            Street, Indiana Street, and 23rd Street; as well as the parcel bounded by Indiana            Street, 22nd Street, Minnesota Street, Tennessee Street, and Tubbs Street.

          (3)  Within the property lines of the SFMTA building commonly known as                 Presidio Operations and Maintenance Yard or 949 Presidio Avenue and 2640             Geary Boulevard (Lot 001, Block 1072) and bounded by Masonic Avenue,                            Euclid Avenue, Presidio Avenue, and Geary Boulevard.

          (4)  Within the property lines of the SFMTA building commonly known as Flynn        Operations and Maintenance Yard or 1940 Harrison Street (Lot 001, Block            3551) and bounded by Fols [begin deletion] u [end deletion] [begin addition] o [end addition] m Street, 15th Street, Harrison Street, and 16th                 Street.

          (5)  Within the property lines of the SFMTA building commonly known as Potrero     Operations and Maintenance Yard or 2500 Mariposa Street (Lot 001, Block            3971) and bounded by 17th Street, Hampshire Street, Mariposa Street, and               Bryant Street.

          (6)  Within the property lines of the SFMTA building commonly known as                 Kirkland Operations and Maintenance Yard or 151 Beach Street and 2301             Stockton Street (Lot 001, Block 0018; Lot 000, Block 2301) and bounded by             Beach Street, Stockton Street, North Point Street, and Powell Street.

          (7)  Within the property lines of the SFMTA building commonly known as Metro       East Operations and Maintenance Yard or 601 25th Street (Lot 001, Block 4297; Lot       001, Block 4299; Lot 001, Block 4313; Lot 004, 4310) and bounded by Cesar Chavez Street, Illinois Street, 25th Street, approximately 745 feet east of Illinois, approximately        738 feet south of 25th Street, and Michigan Street.

          (8)  Within the property lines of the SFMTA property commonly known as Scott        Garage and Scott Non-Revenue Maintenance Shop or 1849 Harrison Street (Lot 002,       Block 3925) and bounded by Harrison Street, Alameda Street, Division Street, and from approximately 27 feet south to 208 feet south of Alameda Street.

          (9)  Within the property lines of the SFMTA property commonly known as Green      Operations and Maintenance Yard and Green Annex or 425 Geneva Avenue (Lot 015,     Block 6949) and bounded by Ocean Avenue, San Jose Avenue, Geneva Avenue, and          the east side of Balboa Park BART Station.

          (10)  Within the property lines of the SFMTA property commonly known as       Geneva Operations and Maintenance Yard or 2301 San Jose Avenue (Lot 036, Block     6972) and bounded by San Jose Avenue, Geneva Avenue, approximately 52 feet west          of Delano Avenue, and approximately 69 feet north of Niagara Avenue.

          (11)    Within the property lines of the SFMTA property commonly known as the           Geneva Upper Yard (Lot 039, Block 6973), located near Green Operations and        Maintenance Yard and Geneva Operations and Maintenance Yard, and bounded by        Geneva Avenue, San Jose Avenue, Niagara Avenue, and the BART right-of-way east          of the southern entrance of Balboa Park BART Station.

(c)      The restrictions listed in subsection (b) shall not apply to any person engaged in the loading and unloading of freight upon or from vehicles Parked for not longer than the posted time limit or 30 minutes if no time limit is posted.

[begin addition] (d)       The monthly parking rate to Park on SFMTA property shall not exceed the cost of a Municipal Railway/BART pass (Fast Pass A) plus ten dollars.  [end addition]
