TWU 250-A (9163) Extension of MOU to 2011

Pursuant to Charter Section A8.404, the San Francisco Municipal Transportation Agency (SFMTA) has authority to bargain its own collective bargaining agreements with labor organizations representing employees in service critical classifications.

Transport Workers Union (TWU) Local 250-A (9163) labor agreement representing service critical employees expired on June 30, 2008.  As set forth in Charter Section 8A.404, SFMTA representatives entered into negotiations with this labor organization.

The parties agreed to amend the agreement by extending the Memorandum of Understanding (MOU) for three (3) years with an expiration date of June 30, 2011.

As required by the City Charter, we provided a copy of the new MOU to the SFMTA Board of Directors as well as an analysis between the previous and proposed agreements. This information was available on our website and we made copies available for the public. This information was posted on August 15, 2008.

The labor agreement was presented to the SFMTA Board for adoption on Tuesday, September 16, 2008, and approved. It can now be found on the Collective Bargaining Agreements page.

 


TWU 200 FY2008 Agreement

NEGOTIATIONS OVERVIEW 2007
TRANSPORT WORKERS’ UNION, LOCAL 200

Proposition E, Charter Section 8A.104(k) and 8A.104(l) gives the Municipal Transportation Agency (MTA) the authority to bargain its own separate collective bargaining agreement with labor organizations representing employees at MUNI in service critical classifications.

One labor agreement representing MUNI service critical employees expired on June 30, 2007: Transport Workers’ Union (TWU), Local 200.  As set forth in Proposition E, Charter Section 8A.104(l), MTA representatives entered into negotiations with this labor organization.

On May 23, 2007, an award was issued as a result of the interest arbitration between the MTA and TWU, Local 200.

Proposition E, Section 8A104(p) provides that the contents of such agreement and an analysis of costs associated with each agreement must be publicly disclosed for at least 30 days prior to adoption by the MTA Board. The agreement was sunshined on May 29, 2007, and approved on June 29, 2007.

TWU 250-A Transit Operator Reopener Agreement 2006

On August 15, 2006, the MTA "sunshined" the MOU with TWU Local 250-A for the required 30-day period. The MOU is scheduled for presentation to the MTA Board for adoption on Tuesday, September 19th.

• The existing MOU between MTA and the Transport Workers Union Local 250-A provides for an economic reopener during the life of the agreement.

• The MTA negotiated an amendment to the existing MOU with the Union and the agreement was subsequently ratified by a vote of the membership on August 8th.

• The amendment added new provisions and modified existing provisions to the current MOU. There was no change to the term of the agreement which expires June 30, 2008

The changes included increasing the premium for line trainers; providing uniform maintenance and shoe allowance on an annual basis; offering the same wellness program which is provided to other service critical employees; providing a monetary reward for the Operator of the Month rather than time off; and modifications for qualifications for overtime compensation when working RDO (regular day off).

Employee Relations and Agreements Municipal Transportation Agency Negotiations Overview 2006

Note: There is no change to the TWU 250-A 9163 MOU.

Proposition E, Charter Section 8A.104(k) and 8A.104(l) gives the Municipal Transportation Agency (MTA) the authority to bargain its own separate collective bargaining agreement with labor organizations representing employees at MTA in service critical classifications.

There were six labor agreements representing MTA service critical employees that expired on June 30, 2006. One contract expires on June 30, 2007 but provides for a reopener on wages and retirement this year:

As set forth in Proposition E, Charter Section 8A.104(l), MTA representatives entered into negotiations with these labor organizations. Agreement was reached with all groups through negotiations and/or a mediation process.

Proposition E, Section 8A104(p) provides that the contents of such agreements and an analysis of costs associated with each agreement must be publicly disclosed for at least 30 days prior to adoption by the MTA Board.

Employee Relations Operation Resolution

The approval of Proposition E by the voters in November 1999 gave the Municipal Transportation Agency the authority to create and modify bargaining units for service critical classifications. The creation of service critical bargaining units was also required in order for the MTA to be able to bargain labor agreements, separate from the City, for service critical classifications.

Proposition E required the agency to establish the necessary policy and procedures for creating and modifying bargaining units.

Meetings were held with the labor organizations representing service critical employees to review and discuss the creation of such polices and procedures. The final result was the creation of the Employee Relations Operation Resolution for service critical employees.
